Panel Remands Mold Injury Case, Says Tenant’s Fraud Cause Of Action Valid

Mealey's (November 30, 2022, 12:24 PM EST) -- DALLAS — A Texas appellate panel on Nov. 29 partially affirmed and partially reversed a mold injury lawsuit brought by a tenant claiming that her landlord is responsible for her injuries.  The panel said that while the statute of limitations had run on some claims, the plaintiff had a valid cause of action for fraud and held that the defendants’ argument for summary judgment, which sought a finding of “no evidence,” failed....
