(September 12, 2022, 1:40 PM EDT) -- CHICAGO — An Illinois trial court erred in granting an insurer’s summary judgment motion in a coverage dispute stemming from faulty work performed by subcontractors at a townhome development because a general contractor’s allegations in support of the insurer’s duty to defend it in an underlying lawsuit “are enough to potentially fall within the Policy’s coverage requirement of ‘property damage’ caused by an ‘occurrence’ and thus trigger a duty to defend,” an Illinois Court of Appeal, First District, panel ruled Sept. 9 in reversing and remanding....
